Maintenance Clause

This Maintenance Clause (This Clause) is the contract concluded between you and the owner of this website (www.whatsminer.com or www.microbt.com) MicroBT when you purchase our products and apply for maintenance clause. You will confirm that this clause is the basis for dealing with the rights and obligations of both parties and is always valid. If there are other mandatory provisions in the law or special agreements between the parties,such provisions or agreements shall prevail.

Please read this clause carefully. If you click “Accept”,it means you have already read,fully understand and accept the restraint of this clause with voluntary.The revised clause will take effect automatically upon announcement.

Tips: Please ready this clause carefully and fully understand it, specially the clause of exempt and restricted liability. If you have any question with it, please contact the service.

Item 1 Definition

The words used in this clause shall have the following meanings unless otherwise defined:

1.1 Customer: refers to natural persons, legal persons or other organizations that registered and purchased products or service for production purposes on this website.

1.2 Product,service: refers to the products or service displayed and sold on this website, including but not limited to mining machine, power supply and ervice and etc.

1.3 Damaged product, faulty product and reprocessed product: refers to the products fails to function properly.

1.4 After-sale maintenance service: refers to the inspection, maintenance and other services provided by MicroBT for the products purchased by customers, divided into maintenance service during the warranty period and maintenance service outside the warranty period.

Item 2 The application of after-sale maintenance service

2.1 If you want the after-sale maintenance service, you need to create an repair work order on the website according to the prompt. Please refer to the website for the specific steps of work order creation:https://www.microbt.com/service/repair_guide.html

2.2 The information you fill in the repair work order should be the same with the package you sent.Otherwise we will not repair it. All damage caused by the wrong information of work order you created, you should responsible for it.

2.3 If the information of work order is different from the package, you agree that the information of work order shall prevail.

Item 3 Delivery of Reprocessed Products

3.1 You need to send the reprocessed products to maintenance point you choose of our company with the payment arranged by yourself.

3.2 In order to avoid damage during the transport, we suggest you to use moisture-proof, spray-proof and fall-proof and other convenient shipping method and repeatable loaded and unloaded packing. We will not responsible for the damage, loss and other risks that occur during the transport of the reprocessed products .

Item 4  Receipt for Reprocessed Products

4.1 Usually, we will sign the normal reprocessed products according to the repair work order,except in the following cases:

4.1.1 It is confirmed that you have not create the repair work order.

4.1.2 It is confirmed that you have not paid the logistics fee.

4.1.3 The packing of the product is damaged serious.

4.2 In case of any of the above situations, MicroBT shall not be liable for any other circumstances except to inform of what has happened in a timely manner if possible. In order to facilitate your timely maintenance of faulty goods and enjoy our service, we may choose to sign your package in accordance with the above-mentioned 4.1.2 and 4.1.3 conditions, but this will not exempt you from the logistics costs and risks in the logistics process.

Item 5  Maintenance

5.1 The maintenance within the warranty period

We will offer free maintain service and pay the return shipping fee for products of MicroBT within the stipulated warranty period.

5.2 The maintenance out of the warranty period

5.2.1 If your product fails out of the warranty period specified by MicroBT, we will disassemble and analyze the specific fault after signing the bad product you sent back. After completing the above steps, we will give a specific repair quotation, the repair price does not exceed but may be equal to the current market price of the machine or accessories. Please contact customer service or Whatsminer official accounts for repair quotation. If you create a repair work order in accordance with this clause and send the repair product to us, you will be deemed to have approved the above repair offer.

5.2.2 We will send the repaired products to the your designated or provided address within 3 working days after we receive your maintenance fee. If you fail to pay the maintenance fee in full and on time, we reserve the right to retain your product; if the aforementioned breach of contract expires 62 days, we have the right to dispose of your product to cover the maintenance fees, custodial fees, and other related expenses that you should paid but not paid.

You shall pay the maintenance fee in RMB.After you complete the payment ,please send the proof of payment ,name of payment bank card holder or third party payment owner, tracking number to the after sales service.If you do not submit the information above,we have the right do not sent the products.

5.2.3 we will retain the parts that were replaced during the repair service for defective parts that are replaced during the repair process.

5.2.4 You agree that we will complete the repair of the fault at the same time during the disassembly and analysis of the fault. You agree to the terms,  it means you agree to the repair fee we have offered.

Item 6 No maintenance

6.1 Non-free maintenance

If any of the following situations exist in the products you apply for maintenance, we will not provide free maintenance services:

6.1.1 Exceed the warranty period .

6.1.2 Damage due to wetting and corrosion of leaching solution, circuit board and components;

6.1.3 The products damaged by man-made and intended.

6.1.4 The label on WhatsMiner machine, hash board and other accessories was teared or altered .

6.1.5 The damage caused by fail to use, repair , maintenance according to the instruction.

6.1.6 Machine damage caused by the use of third-party inferior power supply, burnout marks on circuit boards, or burnout of chips;

6.1.7 Damage caused by force majeure (such as fire, earthquake, lightning strike, etc.);

6.1.8 Man-made disassembly or replacement of spare parts using any third party that do not meet our requirements, resulting in machine damage;

6.1.9 Machine damage caused by software over-frequency;

6.1.10 Fake product;

6.1.11 Machine damage caused by using POE switch;

6.1.12 Disassemble (the label was ripped off) by man-made and private modification and replacement of components

6.1.13 Hash board or chips were broken damaged, burning.

6.1.14 Product damaged caused by high voltage and leakage;

6.1.15 Product damaged caused by high temperature or low temperature.

6.1.16 Any situation that prevents us from judging whether the product is under warranty.

6.2 Non-maintenance situation:

If your product has been scrapped included burned out, corrosion / oxidation, chip pad pin dropout, PCB breakage, plate hole failure, etc., we will not provide maintenance service.

Item 7 Return Reprocessed Product

7.1 In order to avoid the loss of mining revenue caused by the long maintenance time, we will send you the pre-maintenance products randomly under the premise of ensuring the same model.We can not guarantee to send back the original product due to random delivery,so the product you receive may be different in age, but the product efficiency is not affected.

7.2 We currently only support logistics delivery services (please consult the carrier before you send), according to different situation,we will have the right to choose shipping method. If you have any questions, please confirm to our ervice. 

7.3 It usually takes about 7 working days for repair,not included the shipping time.

7.4 The risk of product damaged will transferred to you after we deliver the product to the logistics company. If the product is damaged during the logistics process, you should resolve the dispute with the logistics company.

Item 8 Special Item

8.1 Service exclusion:

If your product is under the warranty period specified by MicroBT, the parts that are not supplied by us or the non Whatsminer brand parts are faulty, the serial number is changed, smeared or removed, or the product is accidentally, abused, spilled or immersed , negligent, misuse (including incorrect installation, repair or maintenance by any person other than us or our authorized service provider), unauthorized modifications, extreme environments (including extreme temperatures or humidity), extreme physical or electrical stress or interference, Failure due to voltage fluctuations or surges, lightning, static electricity, fire, natural disasters, or other external causes. We will directly return the products you return to the warranty and will charge you.

8.2 Export restrictions

You must comply with all applicable export laws and regulations. You may not export or re-export products for service unless authorized by the laws of the mainland of the People's Republic of China.

Itme 9 Disclaimer

9.1 We do not guarantee the customer data that you store in the product or in other forms related to the product, customers should responsible for backing up the relevant data to prevent loss.

9.2 We do not make any form of guarantee for repairing the products successfully, it will depend on the damage level of the products.

9.3 We do not make any form of guarantee for the loss of revenue during the maintenance period.

9.4 We do not responsible for the loss caused for any direct, indirect, incidental, special or consequential damages during repair.In all cases, our liability will not exceed the repair costs you pay for us.

Item 10 Others

10.1 This Terms is inseparable components of the MicroBT User Agreement and the Maintenance Guide and have the same legal effect.

10.2 If there is any conflict between the content of this term and the contents of the maintenance guide, the contents of the maintenance guide shall prevail.

10.3 If the content is not specified in this clause, the contents of the MicroBT User Agreement and the maintenance guide shall prevail.

10.4 The right to interpret this clause belongs to MicroBT.
